These Terms of Service apply to the website Canaima.mt, direct bookings, booking enquiries, guest stays, private gathering enquiries, and any related services offered in connection with Canaima.
By using this website, making an enquiry, confirming a booking, staying aboard Canaima, or using any related service, you agree to these Terms.
1. Operator
The yacht Canaima is operated by the owner of Canaima. For enquiries, booking questions, guest communication, or legal notices, please use the contact form available on our contact page.
2. About Canaima
Canaima is a boutique yacht stay located at Grand Harbour Marina, Pontoon B, Birgu, Malta.
Unless expressly agreed otherwise in writing, bookings are for accommodation aboard Canaima while she remains berthed in the marina. A standard accommodation booking does not include navigation, sailing, skipper services, fuel, transfers, yacht charter, excursions, boat trips, or use of the yacht away from the berth.
Any boat trip, charter, excursion, or similar experience is a separate service, on a separate boat where applicable, with a separate price and separate conditions.
3. Direct Bookings and Platform Bookings
Bookings may be made directly through Canaima.mt or through selected third-party platforms such as Airbnb, Booking.com, or similar booking channels.
For bookings made through a third-party platform, the platform’s own terms, payment rules, cancellation policy, refund rules, service fees, guest verification rules, and dispute process apply.
For direct bookings made through Canaima.mt, these Terms apply together with any booking details shown during checkout or confirmed in writing.
If there is a conflict between these Terms and the terms of a third-party booking platform, the platform terms apply to payment handling, platform fees, platform cancellation rules, refunds, and platform-related disputes. These Terms continue to apply to guest conduct, use of the yacht, house rules, safety rules, damages, visitor rules, event use, and onboard behaviour.
4. Booking Confirmation
A booking is confirmed only once it has been accepted and the required payment, deposit, or booking platform confirmation has been completed.
For direct bookings, payment must be made upfront by bank transfer or another payment method indicated on the website or through the Smoobu booking process.
The operator may decline, cancel, or refuse a booking where reasonably necessary, including in cases of incorrect information, suspected misuse, non-payment, safety concerns, breach of house rules, legal restrictions, marina requirements, payment issues, platform issues, or circumstances beyond the operator’s reasonable control.
5. Prices, VAT, Taxes, Cleaning Fees, and Charges
Prices are shown in euros unless stated otherwise.
For direct bookings, the cleaning fee may be charged separately and shown during the booking process.
For bookings made through third-party platforms such as Airbnb or Booking.com, cleaning fees may be included or charged separately depending on the platform setup and booking conditions shown on the respective platform.
Taxes and mandatory contributions are included in the booking price unless stated otherwise during checkout or in the booking confirmation.
Where VAT applies, VAT will be shown during checkout or in the relevant booking/payment documentation.
6. Direct Booking Cancellation Policy
For direct bookings made through Canaima.mt, the following cancellation policy applies unless expressly agreed otherwise in writing:
- 90% refund if cancelled at least one month before the scheduled check-in date.
- 75% refund if cancelled less than one month but at least 10 days before the scheduled check-in date.
- No refund if cancelled less than 10 days before the scheduled check-in date.
Refunds are calculated on the booking amount actually received, excluding any non-refundable bank charges, payment processing fees, administrative costs, or third-party fees where applicable.
For bookings made through Airbnb, Booking.com, or another third-party platform, the cancellation policy shown on that platform applies.
7. Check-In and Check-Out
Standard check-in is from 4:00 PM.
Standard check-out is before 11:00 AM.
Early check-in or late check-out may be possible only by prior agreement and subject to availability.
Guests must not stay significantly beyond the agreed check-out time, as cleaning and preparation may be required for the next guests.
8. Access, Keys, and Key Fobs
Guests will receive check-in instructions before arrival. Access may be provided through a marina gate, intercom, key fob, key box, or other access method.
Guests must keep all keys, key fobs, access cards, and codes safe and must not share them with unauthorised persons.
At check-out, guests must return keys and access fobs as instructed.
The following charges may apply:
- Lost boat key: €25
- Lost or damaged marina gate key fob: €80
9. Guest Capacity and Minimum Booking Age
The maximum overnight capacity is 5 guests, unless expressly agreed otherwise in writing.
Only the guests included in the booking may stay overnight.
The person making the booking must be of legal age and legally capable of entering into a binding booking agreement.
Additional visitors, day guests, gatherings, or events require prior written approval.
10. Private Gatherings and Events
Canaima may be available for small, relaxed private gatherings, such as birthday drinks, sunset gatherings, casual celebrations, or unique events.
All gatherings and events require prior written approval and a custom offer. The offer may specify the maximum number of guests, event duration, permitted areas, included items, additional services, security deposit, house rules, and special conditions.
Small birthday gatherings and similar calm events may be permitted, provided they remain respectful and do not disturb neighbouring yachts, marina users, marina staff, local residents, or nearby businesses.
Loud music, disruptive parties, excessive noise, unsafe behaviour, nuisance, or unauthorised event use are not permitted.
The operator reserves the right to end an event or stay immediately if guests breach safety rules, marina rules, house rules, or agreed event conditions.
11. House Rules
Guests and visitors must comply with all house rules provided before or during check-in.
House rules may include rules on:
- Noise and quiet hours
- Smoking
- Children and supervision
- Pets
- Visitors
- Use of the bow plunge pool
- Use of bathrooms and marine toilets
- Kitchen use
- Waste disposal
- Marina access
- Safety around water
- Prohibited activities
- Check-out procedures
House rules may be updated from time to time for safety, operational, legal, or marina-related reasons.
12. Yacht-Specific Conditions
Canaima is a real yacht, not a standard apartment or hotel room.
Guests should expect yacht-specific features such as compact spaces, steps, narrow passages, marine toilets, movement on the water, railings, outdoor decks, and proximity to water.
Guests must take care when moving around the yacht, especially on stairs, outdoor areas, the bow, the flybridge, wet surfaces, or at night.
Guests use the yacht, pontoons, outdoor areas, marina access routes, and onboard facilities responsibly and at their own risk, subject to applicable law.
13. Children
Children are allowed aboard Canaima, but they must be supervised by a responsible adult at all times.
The booking adult is responsible for children at all times. A yacht and marina environment includes steps, railings, water access, moving surfaces, ropes, equipment, and other risks that require constant supervision.
Children must not use outdoor areas, the bow, flybridge, pontoon, or plunge pool unsupervised.
14. Pets
Pets are not permitted unless expressly agreed otherwise in writing before booking.
15. Smoking
Smoking inside the yacht is strictly prohibited.
Smoking may be permitted outside only, using an ashtray, and only where it does not create fire risk, nuisance, damage, or breach marina rules.
Smoking near entrances, open doors, windows, or ventilation areas is not permitted.
A charge of €200 may apply for smoking inside the yacht.
Guests are responsible for safe disposal of cigarette waste. Cigarette waste must not be thrown into the sea, marina, or onto the pontoon.
16. Bathrooms, Showers, and Marine Toilets
Canaima has private bathrooms onboard with showers inside them. Yacht bathrooms and showers are more compact than standard household or hotel bathrooms.
Marine toilets are sensitive and must be used carefully. Guests must only flush what is specifically permitted in the guest instructions. Wet wipes, sanitary products, cotton pads, paper towels, food, and similar items must not be flushed.
If a marine toilet becomes blocked because a guest flushed something that should not have been flushed, a charge of €200 may apply.
Marina bathrooms and showers are usually available as shared marina facilities and may be accessed using the marina key fob. These shared facilities are operated by the marina and are not private to Canaima. Their availability may change and is not guaranteed by the operator of Canaima.
17. Bow Plunge Pool and Outdoor Areas
Use of the bow plunge pool and outdoor areas is subject to weather, cleaning, maintenance, safety, and operational conditions.
Guests must use the bow plunge pool responsibly. No diving, jumping, rough play, glassware near the pool, or unsupervised child use is permitted.
The bow plunge pool is not a lifeguarded facility.
The operator may restrict or prohibit use of outdoor areas or the bow plunge pool where required for safety, weather, cleaning, maintenance, or operational reasons.
18. Swimming, Fishing, Diving, Water Sports, and BBQs
Swimming, fishing, diving, and water sports are not permitted inside the marina.
BBQs, candles, fireworks, open flames, hazardous substances, and similar items are not permitted onboard or near the yacht unless expressly approved in writing.
Guests must comply with all marina rules and instructions.
19. Noise and Neighbours
Canaima is located in a marina with neighbouring yachts, local residents, restaurants, and other marina users nearby.
Guests must keep noise at a reasonable level at all times, especially in the evening and at night.
Music, conversations, celebrations, and gatherings must not disturb neighbouring yachts, marina users, marina staff, local residents, or nearby businesses.
20. Cleaning and Maintenance
Canaima will be cleaned and prepared before guest arrival.
Guests must use the yacht respectfully and leave it in a reasonable condition at check-out.
Excessive cleaning may be charged at €20 per hour.
Lost or damaged towels or linen may be charged at €30 per item or set, depending on the item.
Access may be required during a stay for urgent maintenance, safety checks, marina requirements, repairs, cleaning, or emergency situations. Where practical, the operator will inform guests in advance.
21. Damages, Losses, and Charges
Guests are responsible for any damage, loss, breakage, missing items, excessive cleaning, misuse of equipment, blocked toilets, lost keys or access fobs, breach of house rules, or costs caused by the guest or any visitor invited by the guest.
The following charges may apply:
- Lost boat key: €25
- Lost or damaged marina gate key fob: €80
- Blocked marine toilet due to incorrect use: €200
- Smoking inside the yacht: €200
- Excessive cleaning: €20 per hour
- Lost or damaged towels/linen: €30
If actual damage or loss exceeds these amounts, the operator may claim the higher actual cost where permitted by law or the applicable booking platform rules.
22. No Refunds for Certain Circumstances
No refund is due where a guest fails to arrive, checks out early, breaches house rules, is removed due to misconduct, or cannot use certain outdoor areas due to weather, safety, cleaning, maintenance, or marina conditions, unless required by applicable law or expressly agreed in writing.
For bookings made through Airbnb, Booking.com, or another third-party platform, the applicable platform rules may apply.
23. Changes, Unavailability, and Force Majeure
Canaima is located on the water and may be affected by weather, wind, rain, heat, marina activity, technical systems, water movement, or other external conditions.
Outdoor areas may not always be usable due to weather or safety reasons.
The operator is not responsible for events beyond reasonable control, including severe weather, power or water interruptions, marina restrictions, government measures, ferry disruption, technical failures, accidents, emergency repairs, strikes, pandemics, security incidents, or other force majeure events.
If a stay cannot reasonably proceed due to circumstances beyond the operator’s reasonable control, the operator may offer alternative dates, a partial refund, a full refund, or another reasonable solution depending on the circumstances, the booking channel, and applicable law.
24. Guest Responsibility
Guests are responsible for:
- Providing accurate booking information
- Respecting check-in and check-out times
- Following house rules and safety instructions
- Supervising children and visitors
- Avoiding nuisance or disturbance
- Taking care of the yacht and its contents
- Reporting damage, faults, or incidents immediately
- Using marine toilets correctly
- Returning keys and access fobs
- Paying for damage, loss, excessive cleaning, or rule breaches
25. Personal Belongings
Guests are responsible for their own belongings.
The operator is not responsible for lost, stolen, or damaged personal items unless caused by proven negligence or where liability cannot be excluded under applicable law.
Found items may be returned at the guest’s cost.
26. Limitation of Liability
To the maximum extent permitted by law, the operator is not liable for indirect losses, loss of enjoyment, travel disruption, loss of personal belongings, platform issues, third-party services, weather conditions, marina activity, noise from nearby areas, or events outside the operator’s reasonable control.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by law.
27. Website Content
The content on Canaima.mt is provided for general information, marketing, enquiry, and booking purposes.
The operator aims to keep the website accurate and up to date, but details such as availability, pricing, amenities, photos, rules, services, access methods, and facilities may change.
Images are for general presentation purposes and may not show every current detail, setup, or seasonal variation.
28. Third-Party Links and Services
Canaima.mt may link to third-party platforms, booking systems, payment providers, maps, social media pages, WhatsApp, Airbnb, Booking.com, Smoobu, or other external services.
The operator is not responsible for the content, availability, terms, privacy practices, fees, or performance of third-party websites or services.
29. Data Protection and Privacy
Personal data is processed in accordance with the Privacy Policy available on Canaima.mt.
By making an enquiry or booking, guests acknowledge that personal data may be processed for booking management, guest communication, payment, tax, legal, security, and operational purposes.
30. Complaints and Issues During the Stay
Guests should report any issue, damage, missing item, safety concern, or problem as soon as possible during the stay so that the operator has a reasonable opportunity to resolve it.
Complaints made only after check-out, where the operator was not given a reasonable opportunity to address the issue during the stay, may be more difficult to assess.
31. Governing Law and Jurisdiction
These Terms are governed by the laws of Malta.
Any dispute shall be subject to the jurisdiction of the competent courts of Malta, unless mandatory consumer protection rules provide otherwise.
32. Changes to These Terms
The operator may update these Terms from time to time.
The latest version will be published on Canaima.mt. The version applicable to a booking is generally the version in force at the time the booking is confirmed, unless changes are required by law, safety, marina rules, or operational necessity.
